Passenger Restraint Systems for Adults.
Effective July 1, 2007
IC 9-19-10-2
Each occupant of a passenger motor vehicle that is equipped with a safety belts must be properly fastened when the vehicle is in forward motion.
This now includes pick-up trucks, SUV's and vans.
IC 9-19-10-3
A law enforcement officer may stop a vehicle if there is reasonable suspicion that its operator is in violation of the safety belt statute. However, a vehicle, the contents of a vehicle, the driver or a passenger in a vehicle may not be inspected, searched or detained solely because of a violation of this chapter
IC 9-19-10-8
A person who (1) is at least sixteen (16) years of age; and (2) violates section 2 of this chapter commits a Class D infraction.
Exemptions to the passenger restraint systems for adults.
IC 9-19-10-1
Exemptions: medical reasons: children covered by IC 9-19-11; commercial or Postal Service vehicle that makes frequent stops; rural Postal Service carriers; newspaper route carrier or newspaper bundle hauler; driver examiners; vehicles that are not passenger motor vehicles, ie, motorcycles, tractors, recreation vehicles.
Indiana Child Passenger Law
Effective July 1, 2005
Children are required to ride properly restrained in a child restraint, which can include a belt positioning booster seat, until they reach their 8th birthday. (This does not include shoulder belt positioners.)
If at court proceedings, a driver who has received a violation under this code possesses or has acquired a child restraint system, the driver is not liable for any costs or monetary judgment if the person has no previous judgments of violation of this chapter against the person.
Fees collected from violations will be entered into a fund to purchase child restraints for low income families throughout Indiana.
Exemptions:
If all lap/shoulder seat belts are being used by other children, then a child over 40 pounds may ride in a lap only seat belt without a child restraint. (Booster seats cannot be safely used with a lap only seat belt.)
Passenger Restraint Systems for Children.
IC 9-19-11-2
A person who holds an Indiana driver's license and operates a motor vehicle in which there is a child less than eight (8) years of age who is not properly fastened and restrained by a child passenger restraint system in accordance with the manufacturer's instruction commits a Class D infraction, unless it is reasonably determined that the child will not fit in a child passenger restraint system
IC 9-19-11-3
A person who operates a motor vehicle in which there is a child commits a Class D infraction if: (1) the child is less than Eight (8) years of age and it is reasonably determined that the child will not fit in a child restraint system; and (2) the child is not properly fastened and restrained by a safety belt.

IC 9-19-11-3.6
A person who operates a motor vehicle in which there is a child and that is equipped with a safety belt meeting the standards stated in the Federal Motor Vehicle Safety Standard Number 208 (49 CFR 571.208) commits a Class D infraction if the child is at least eight (8) years of age but less than sixteen (16) years of age and not properly fastened and restrained according to the child restraint system manufacturer's instructions by a child restraint system or safety belt.

A lap safety belt may be used to restrain a child who weighs more than 40 pounds if the motor vehicle is not equipped with lap and shoulder safety belts all other lap and shoulder safety belts are being used to properly restrain other children who are less than sixteen (16) years old.
Exemptions to the passenger restraint systems for children.

Exemptions for operators of: school bus; taxicab; ambulance; public passenger bus; a motor vehicle having a seating capacity greater than nine (9) individuals that is owned or leased and operated by a religious or not-for-profit youth organization; antique motor vehicle; motorcycle; motor vehicle that is owned or leased by a governmental unit and is being used in the performance of official law enforcement duties; motor vehicle that is being used in an emergency.
